Terms of Service

By accessing or using the SMSForwarding.com platform, API, web dashboard, or Android gateway application (collectively, the "Service"), you agree to be legally bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

These Terms apply to all users of the Service, including individuals accessing the Service on behalf of a company or other legal entity. You represent and warrant that:

• You are at least 18 years of age
• You have the legal authority to enter into these Terms on behalf of yourself or your organisation
• Your use of the Service will comply with all applicable laws and regulations in your jurisdiction
• The information you provide during registration is accurate and complete

SMSForwarding.com provides a managed SMS gateway API platform. We act as the facilitator — sitting between your registered Android device and your application:

The Service is provided on a subscription basis. Features available to you depend on your chosen subscription plan. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with reasonable notice where possible.

To use the Service you must register an account. You agree to:

• Provide accurate, current, and complete information during registration
• Keep your account credentials confidential and not share them with any third party
• Notify us immediately at [email protected] if you suspect unauthorised access to your account
• Be solely responsible for all activity that occurs under your account

You may only maintain one account per business entity. We reserve the right to terminate duplicate accounts or accounts created with false information. The Service is intended for business and developer use only — it is not a consumer product.

You are solely responsible for all content, messages, and data transmitted through the Service. You agree not to use the Service to:

• Send unsolicited bulk messages (spam) or engage in any form of unsolicited commercial communication
• Send messages that are deceptive, fraudulent, phishing-related, or designed to impersonate any person or organisation
• Transmit illegal, harmful, threatening, abusive, harassing, defamatory, or obscene content
• Facilitate or participate in any illegal activity, including but not limited to fraud, money laundering, or identity theft
• Send messages to recipients who have not consented to receive communications from you, where such consent is required by applicable law
• Resell, sublicense, or commercially redistribute the Service or API access without our express written permission
• Reverse engineer, decompile, or attempt to extract the source code of any part of the platform or Android app
• Overload or abuse the API beyond your plan limits, or attempt to circumvent rate limiting
• Use the Service in any way that could damage, disable, or impair the platform or interfere with other customers

Access to the SMSForwarding.com REST API is subject to the following conditions:

• API usage is limited by the rate limits and message quotas defined in your subscription plan
• You must keep your API keys confidential — do not embed them in client-side code or public repositories
• Each API key is tied to your account; you are responsible for all requests made using your keys
• We may suspend API access temporarily if we detect abusive traffic patterns, without prior notice
• We reserve the right to adjust rate limits at any time to maintain platform stability for all customers
• Automated testing or load testing against our production API is prohibited without prior written consent

Access to paid features of the Service requires an active subscription:

• Subscriptions are billed on a recurring basis (monthly or annually, depending on your chosen plan) via our payment gateway
• Your subscription renews automatically at the end of each billing period unless you cancel before the renewal date
• You authorise us to charge your account via our payment gateway for the applicable subscription fee on each renewal date
• We reserve the right to change subscription pricing with at least 14 days written notice to your registered email address
• You are responsible for any applicable taxes, duties, or levies imposed on the subscription fees in your jurisdiction
• All fees are quoted in US Dollars (USD) unless otherwise stated
• Failure to pay may result in suspension or termination of your account

All subscription fees are governed by our Refund Policy. In summary, subscription fees are non-refundable — please review the Refund Policy in full before subscribing.

We make reasonable efforts to maintain high availability of the Service. However:

• We do not guarantee uninterrupted or error-free operation of the Service
• Scheduled maintenance will be communicated in advance where possible
• We are not liable for outages or failures caused by your Android device, your SIM card carrier, your internet connection, or your webhook endpoint
• We are not liable for delays or failures caused by third-party services we depend on, including Firebase Cloud Messaging (FCM) or our payment gateway provider
• No SLA (Service Level Agreement) is provided on the free plan; paid plans are subject to reasonable availability efforts

All intellectual property rights in the SMSForwarding.com platform, API, web dashboard, Android application, branding, and documentation are owned by or licensed to SMSForwarding.com. Nothing in these Terms grants you any rights in or to the platform beyond the limited licence to use the Service as described herein.

You retain full ownership of your data — including your account information, SMS message logs, webhook configurations, and API keys. By using the Service, you grant us a limited, non-exclusive licence to process your data solely for the purpose of providing the Service to you.

You may not use our name, logo, or branding in any marketing materials or public statements without our prior written consent.

To the fullest extent permitted by applicable law:

• The Service is provided "as is" and "as available" without warranties of any kind, express or implied
• We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
• This includes, without limitation, loss of revenue, loss of data, loss of business opportunity, or reputational damage
• Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the total fees you paid to us in the three (3) months immediately preceding the claim

Some jurisdictions do not allow the exclusion of certain warranties or limitation of certain liabilities. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

Either party may terminate the service relationship at any time:

• You may cancel your account at any time via the Subscription page in your dashboard or by contacting [email protected]
• Cancellation takes effect at the end of your current billing period; you retain access until then
• We may suspend or terminate your account immediately if you violate these Terms, engage in abusive behaviour, or fail to pay outstanding fees
• We may also terminate your account with 30 days written notice if we discontinue the Service
• Upon termination, your right to access the Service ceases immediately (or at end of billing period for voluntary cancellation)
• Your data will be retained for 30 days following termination, after which it will be permanently deleted from our systems

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Jorhat, Assam, India.

If you are a customer located outside India, you acknowledge that you are contracting with a service provider based in India and that Indian law governs the relationship. Nothing in this clause limits your rights under mandatory consumer protection laws applicable in your own jurisdiction.

We may update these Terms from time to time to reflect changes in our platform, legal requirements, or business operations. When we make material changes, we will:

• Update the "Last Updated" date at the top of this page
• Send an email notification to all registered account holders at least 14 days before the changes take effect
• Display a notice in the web dashboard

Continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree with the revised Terms, you must cancel your account before the effective date.
